General History

The Mid Sussex Paynes are primarily based in the parishes of East Grinstead, West Hoathly & Ardingly, but with some additions in Balcombe, Lindfield & Cuckfield. They lived mainly in an area about 6 miles wide and 9 miles long with East Grinstead town in the North at the top centre. To the far east is Ashurstwood (with Pickstones and Wallhill towards Forest Row). South east of East Grinstead the Paynes occupied farms in a big arc starting with Brambletye (Horseshoe & Busses) to Plawhatch, Legsheath , Monkshill, Maules (or Mayes), Walesbeech (not on map) and, later, Charlwoods. Then extending south and west to Stonelands near West Hoathly, Hapset (or Hapstead) in Ardingly to West Hill & Stoneplace which are closer to Balcombe than Ardingly. This is not including those Paynes who were in Cuckfield and Wickham in Lindfield . (Other named places (but not shown on map) are The Lodge & Liod in Ardingly & Blackwell in East Grinstead).
There appears to be three distinctive groups of Paynes. "Paynes of the Town" based in East Grinstead town and East, "Paynes of Plawhatch" in the farms of the south and "Paynes of Stoneland" based around Ardingly. All these groups are certainly interlinked but the links are still unclear so they are currently shown as three separate Family Groupings.To provide the overall picture, the groups have been mapped to about the mid 1600's but there are omissions and a number of assumptions making it difficult to get an accurate comprehensive understanding.

Key Dates:

Edward Payne was probably born on about 1480 in Ardingly, Sussex . He lived at Lodge House. Edward left a 'Will' dated 6th March 1559 and died prior to 1566.

Edward had two known children but probably others. The children shown below are not necessarily children of Edward but all lived in the West Hoathly/Ardingly areas.

  1. Thomas Payne was probably born in about 1510 in Ardingly, Sussex (derived as no birth record found). He was mentioned in his father Edward Payne's 'Will' of 1559. Details of Thomas Payne are shown separately as they are direct ancestors.
  2. John Payne was probably born in about 1520 in Ardingly, Sussex (derived as no birth record found). He was mentioned in his father Edward Payne's 'Will' of 1558 and he inherited Lodge House. He was a witness of John Payne of Liod's 'Will' of 1592. He was possibly buried on 15th May 1595 in Ardingly, Sussex ('of the Lodge'). He married firstly Amy. Amy was buried on 12th December 1562 in Ardingly, Sussex ('wife of John of Liode'). He married secondly Joan. Joan was buried on 20th September 1582 in Ardingly, Sussex ('wife of John of Liode (or Lodge)'. John had & Amy had maybe five children (A-E) and John & Joan had six children (F-J). Note: unsure whether Lodge & Liod are part of the same properties- maybe errors-see child F.
    1. Leonard Payne was possibly born in about 1554 possibly in Ardingly, Sussex (derived as no birth record found - NOTE: there is no indication who his parents were. The only tie in with the Liod family is son Francis). He married Mary Drew on 28th April 1570 in Ardingly, Sussex (Lenard & Marye). Leonard & Mary had five children.
      1. Henry Payne was baptised on 3rd May 1573 in Ardingly, Sussex ('son of Lenard'). He maybe possibly (but see also Henry Payne son of Thomas 1510) married Joan Broocker on 27th February 1598 in Ardingly, Sussex. Joan was buried on 13th February 1631 in Ardingly, Sussex (' Joane, wife of Henry Paine'). Henry left a 'Will' dated 7th January 1633 and was buried on 19th January 1633 in Ardingly, Sussex ('an old man'). Henry & Joan had possibly five children.
        1. Richard Payne was born in about 1600 in Ardingly, Sussex (derived as no birth record found). He was mentioned in his father's 'Will' of 1633 as executor. He had at least one child Henry who was mentioned in his grandfather Henry Paine's 'Will' of 1633.
        2. Joan Payne was born in about 1600 in Ardingly, Sussex (derived as no birth record found). She was mentioned in her father's 'Will' of 1633 as Joan, wife of Roger Botting. She had at least one child Eleanor who was mentioned in her grandfather Henry Paine's 'Will' of 1633 as .Eleanor Botting dau of Roger.
        3. Susan Payne was born in about 1600 in Ardingly, Sussex (derived as no birth record found). She was mentioned in her father's 'Will' of 1633 as Susan, wife of John Paltocke.
        4. Ano Payne (Paine) was buried on 3rd February 1599 in Ardingly, Sussex ('unbaptised child of Henry Paine').
        5. Ano Payne (Paine) was buried on 24th March 1607 in Ardingly, Sussex ('unbaptised child of Henry Paine').
      2. Anne Payne (An Paine) was baptised on 4th September 1575 in Ardingly, Sussex ('dau of Leonard').
      3. John Payne (Paine) was baptised on 23rd November 1578 in Ardingly, Sussex ('son of Leonard') and was buried there on 28th December 1578 ('son of Leonard Paine').
      4. William Payne (Paine) was baptised on 18th April 1580 in Ardingly, Sussex ('son of Leonard').
      5. Francis Payne (Paine) was baptised on 22nd December 1583 in Ardingly, Sussex ('son of Leonard').
    2. Alexander Payne (Paine) was possibly born in about 1556. He was mentioned in Alexander Payne's 'Will' of 1558 as 'Godson'. There is nothing showing that he was a son of John. However in his 'Will' he mentions his brothers Francis & John and in his burial he is shown 'of Liod'. In 1593 Alexander purchased Cross farm in Waldron (see 'Will'). Alexander left a 'Will' dated 20th February 1611 and was buried on 23rd February 1611 in Ardingly, Sussex ('Paine, of Liod').
    3. John Payne (Paine) was baptised on 10th November 1558 in Ardingly, Sussex ('son of John) and was buried on 7th October 1559 in Ardingly, Sussex ('son of John of Liode')
    4. Elizabeth Payne (Paine) was baptised on 22nd June 1561 in Ardingly, Sussex ('dau of John of Liod') and she was buried there on 5th July 1561 (' dau of John of Liode')
    5. Mary Payne (Marye Paine) was baptised on 6th December 1562 in Ardingly, Sussex ('dau of John of Lyod') and she was buried there on 12th December 1562 (' dau of John of Liode')
    6. Edward Payne (Paine) was baptised on 9th February 1565 in Ardingly, Sussex ('son of John of Lodge'). He had children. He was possibly buried on 28th May 1597 in Ardingly, Sussex ('of the Lodge')

    7. John Payne (Paine) was baptised on 25th June 1566 in Ardingly, Sussex ('son of John of Lyod'). He lived at the "Liod". John married Mary Gasson on 14th January 1583 in Ardingly, Sussex ( John Payne of Liode & Marye). John left a 'Will' dated 19th February 1592 and he was buried on 20th February 1592 in Ardingly, Sussex. Mary was mentioned in her husband's 'Will' of 1592 as executor. Mary married secondly Robert Maineard on 4th June 1592 in Ardingly, Sussex (Mary Paine, widow of John Paine of Liod). John & Mary had three children
      1. Elizabeth Payne (Paine) was baptised on 20th November 1586 in Ardingly, Sussex ('dau of John of Liod'). She was mentioned in her father's 'Will' of 1592 as under 21 and the eldest daughter.
      2. Mary Payne (Marye Paine) was baptised on 19th May 1589 in Ardingly, Sussex ('dau of John of Liod'). She was mentioned in her father's 'Will' of 1592 as under 21 and second daughter.
      3. Anne Payne (Paine) was baptised on 1st January 1592 in Ardingly, Sussex ('dau of John of Liode'). She was mentioned in her father's 'Will' of 1592 as under 21 and the youngest daughter.
    8. Francis Payne (Paine) was baptised on 10th May 1568 in Ardingly, Sussex ('son of John of Liode'). He probably married Anne Ilman on 20th November 1597 in Balcombe, Sussex (Anne a widow). Francis was buried on 20th April 1626 in East Grinstead, Sussex. Francis & Anne had four children.
      1. Mary Payne was baptised on 11th July 1602 in East Grinstead, Sussex (dau of Francis).
      2. Alexander Payne was baptised on 24th November 1605 in East Grinstead, Sussex (son of Francis). He was mentioned in Alexander Payne's 'Will' of 1611 as under 16 and son of brother Francis.
      3. Francis Payne was baptised on 29th October 1609 in East Grinstead, Sussex (son of Francis) and he was buried there on 21st November 1614 (a child).
      4. Katherine Payne was baptised on 18th December 1613 in East Grinstead, Sussex (dau of Francis & Anne).

    1. Richard Payne was born in about 1530 in Ardingly, Sussex (derived as no birth record found- but see Archive item 4). He married Margaret and he died prior to 1551.
    2. John Payne (Paine) was born in about 1535 in Ardingly, Sussex (derived as no birth record found- but see Archive item 4). He lived at the "Hapset".
      1. Anne Payne (Annis Paine) was baptised on 2nd February 1561 in Ardingly, Sussex ('dau of John of Hapset').
      2. John Payne (Paine) was baptised on 3rd October 1563 in Ardingly, Sussex ('son of John of Hapset'). He was possibly buried on 28th October 1571 in Ardingly, Sussex ('heir of Hapset')
      3. Margaret Payne (Paine) was baptised on 6th October 1566 in Ardingly, Sussex ('dau of John of Hapset').
      4. Joan Payne (Paine) was baptised and buried on 1st February 1578 in Ardingly, Sussex ('dau of John of Hapset').
    3. George Payne was possibly born in about 1540. He was shown in an Arbitration award of 1576 (see Archives item 6) as son and heir of John Payne late of Hapset in Ardingly, forester.
  4. Thomas Payne (Paine) was born in about 1520 in Ardingly, Sussex (derived as no birth record found). He lived at "Westhill" in Ardingly. He married Joan. Joan was buried on 24th April 1568 in Ardingly, Sussex ('Jone Paine, wife of Thomas of Westhill'). Thomas left a 'Will' that was dated 30th March 1573 and he was buried on 3rd April 1573 in Ardingly, Sussex ('Thomas Paine the Elder of Westhill')
    1. Richard Payne (Paine) was born in about 1545 in Ardingly, Sussex (derived as no birth record found). He was mentioned in his father's 'Will' of 1573 as eldest son. He possibly married firstly Margaret. Margaret was buried on 29th March 1566 in Balcombe, Sussex ('wife of Richard Paine'). Richard married secondly Katherine Balcombe (a widow) on 7th October 1566 in Balcombe, Sussex. Katherine was possily buried on 30th March 1588 in Balcome, Sussex (unnamed -wife of Richard Paine of Bushe'). Richard & Katherine had possibly nine children.
      1. Joan Payne (Jone) was baptised on 6th October 1568 in Balcombe, Sussex ('dau of Rychard') and she was buried there on 26th September 1573 ('dau of Richard')
      2. Thomas Payne was baptised on 25th February 1571 in Balcombe, Sussex ('son of Rychard'). He was mentioned in his grandfather Thomas Payne's 'Will' of 1573 as Thomas Paine.
      3. Job Payne was baptised on 9th October 1573 in Balcombe, Sussex ('son of Richard').
      4. Edward Payne was baptised on 15th August 1575 in Balcombe, Sussex ('son of Richard').
      5. Jane Payne was baptised on 29th April 1576 in Balcombe, Sussex ('dau of Richard').

    2. Isabell Payne (Paine) was born in about 1550 in Ardingly, Sussex (derived as no birth record found). She married John Outred on 22nd June 1572 in Ardingly, Sussex (as Isabelle). Isabell was mentioned in her father's 'Will' of 1573 but unnamed (but was elder sister of Elizabeth) but the 'Will' mentioned his son in law John Outred. Isabelle & John had at least one child (George) who was mentioned in his grandfather Thomas Payne's 'Will' of 1573.
    3. John Payne (Paine) was born in about 1550 in Ardingly, Sussex (derived as no birth record found). He lived at "Westhill". He was mentioned in his father's 'Will' of 1573 as executor. He married Isabell Comber (Cumber) on 24th January 1583 in Ardingly, Sussex ('John of Westhill').
    4. Thomas Payne (Paine) was born in about 1550 in Ardingly, Sussex (derived as no birth record found). He lived at the "Westhill". He was mentioned in his father's 'Will' of 1573 as executor. He probably married firstly Elizabeth Ferral on 28th November 1573 in Ardingly, Sussex. Elizabeth was buried on 22nd October 1576 in Ardingly, Sussex ('wife of Thomas Paine of Westhill'). Thomas probably married secondly Joan Vennoull on 9th (or 30th) September 1578 in Ardingly, Sussex. Thomas & Elizabeth had two children (a-b), Thomas & Joan had six children (c-h).
      1. John Payne (Paine) was baptised on 16th September 1575 in Ardingly, Sussex ('son of Thomas of Westhill') and he was buried there on 2nd November 1575.
      2. Joan Payne (Joane Paine) was baptised on 20th October 1576 in Ardingly, Sussex and was buried there on 21st October 1576 ('Joane dau of Thomas Paine of Westhill').
      3. Thomas Payne (Paine) was baptised on 19th July 1579 in Ardingly, Sussex ('son of Thomas of Westhill').

He left a 'Will dated 30th September 1559 and was probably buried on 12th January 1560 in Lindfield, Sussex . He possibly had five children (but 'will' transcript is very unsure).
    1. John Payne was born in about 1535 in possibly Lindfield, Sussex (derived as no birth record found). He was mentioned in his father's 'Will' of 1559 as executor. He later lived at 'Wickham' in Lindfield. His first wife (unnamed) was buried on 23rd May 1573 in Lindfield, Sussex. His second wife (unnamed) was buried in February 1576 in Lindfield, Sussex. In 1576 John was involved in Arbitration award of 'Hapset' in Ardingly (see Archive item 6 and also Family Ref 4 above). John had seven children.
      1. John Payne was probably born in about 1557 in Lindfield, Sussex and he was probably buried there on 5th February 1560 ('of Wickham').
      2. Thomas Payne (Paine) was buried on 19th May 1559 in Lindfield, Sussex ('son of John of Wickham').
      3. Joan Payne (Jone Paine) was buried on 1st June 1559 in Lindfield, Sussex ('child').

      1. Richard Payne was probably born in about 1560 in Lindfield, Sussex (derived as no birth record found and may be a completely differant Richard). Nearly all the family seems to have died in August 1603, presumably from a plague. Richard was possibly buried on 13th August 1603 in Lindfield, Sussex and his wife (unnamed) was buried there on 28th August 1603. Richard had eight children.
        1. John Payne was baptised on 9th August 1587 in Lindfield, Sussex ('son of Richard').
        2. Elizabeth Payne (Paine) was baptised on 16th February 1589 in Lindfield, Sussex ('dau of Richard') and she was buried there on 29th August 1603 ('dau of Richard').
        3. Richard Payne was baptised on 6th December 1590 in Lindfield, Sussex ('son of Richard').
        4. Gregory Payne was possibly born in about 1593 in Lindfield, Sussex (derived as no birth record found) and was buried there on 13th August 1603 ('son of Richard').
        5. Anne Payne was baptised on 6th April 1595 in Lindfield, Sussex ('dau of Richard') and she was buried there on 12th September 1603 ('dau of Richard').
        6. Mary Payne was baptised on 11th September 1597 in Lindfield, Sussex ('dau of Richard') and she was buried there on 29th August 1603 ('dau of Richard').
        7. Thomasin Payne (Tomson) was baptised on 24th March 1600 in Lindfield, Sussex ('dau of Richard') and she was buried there on 28th August 1603 ('Tomsin, dau of Richard').
        8. Thomas Payne was possibly baptised on 9th March 1602 in Cuckfield, Sussex and he was buried on 31st August 1603 in Lindfield, Sussex ('son of Richard').
    4. Anne Payne was born in about 1542 in possibly Lindfield, Sussex (derived as no birth record found). She was mentioned in her father's 'Will' of 1559 as under 21.
    5. Margaret? Payne was born in about 1544 in possibly Lindfield, Sussex (derived as no birth record found). She was mentioned in her father's 'Will' of 1559 as under 21.
  6. Alexander Payne was born in about 1510 in possibly Ardingly, Sussex (derived as no birth record found). He later married and lived in Balcombe. He married secondly Eleanor (Ellynor) in about 1536. Alexander left a 'Will' dated 18th December 1558. Alexander had three children with his first wife and and had possibly eight children with Eleanor. Eleanor was mentioned in her husbands will of 1558 as executor.
    1. Richard Payne was born in about 1530. He was mentioned in his father Alexander Payne's 'Will' of 1558 (and probably over 18).
    2. Agnes Payne was born in about 1532. She was mentioned in her father Alexander Payne's 'Will' of 1558 (as Agnes Gele).
    3. Anne Payne (or Amie) was born in about 1534. She was mentioned in her father Alexander Payne's 'Will' of 1558 (unmarried and probably over 18).
    4. Thomas Payne was born in about 1538. He was mentioned in his father Alexander Payne's 'Will' of 1558 (probably over 18 and mother was Elynor).
    5. William Payne was baptised on 19th May 1540 in Balcombe, Sussex ('son of Alexander'). He was mentioned in his father Alexander Payne's 'Will' of 1558 (as under 18 and mother was Elynor).
    6. John Payne was baptised on 17th May 1541 in Balcombe, Sussex ('son of Alexander'). He was mentioned in his father Alexander Payne's 'Will' of 1558 (as under 18 and mother was Elynor).
    7. Elizabeth Payne (Elsabeth) was born & baptised on 21st April 1543 in Balcombe, Sussex (no parents shown) and presumed died young as not mentioned in the 'Will'.
    8. Robert Payne was born & baptised on 24th November 1546 in Balcombe, Sussex (no parents shown). He was mentioned in his father Alexander Payne's 'Will' of 1558 (as under 18 and mother was Elynor).
    9. Henry Payne was born & baptised on 13th August 1547 in Balcombe, Sussex ('son of Alyxander & Ellynor'). He was mentioned in his father Alexander Payne's 'Will' of 1558 (as under 18 and mother was Elynor).
    10. Joan Payne (Jone) was born & baptised on 6th October 1548 in Balcombe, Sussex ('dau of Alyxander & Ellynor'). She was mentioned in her father Alexander Payne's 'Will' of 1558 (as Johane, under 18 and mother was Elynor).
    11. Ciscely Payne (Cysle) was baptised on 27th May 1551 in Balcombe, Sussex ('dau of Alexander'). She was mentioned in her father Alexander Payne's 'Will' of 1558 (as Cecilia, under 18 and mother was Elynor).
  7. Henry Payne was born in about 1510 in possibly Ardingly, (or maybe West Hoathly), Sussex (derived as no birth record found). He married Elizabeth (see Archives item 5). Henry died in about 1559. Henry & Elizabeth had at least one child
    1. Henry Payne was born in about 1552 in possibly Ardingly, (or maybe West Hoathly), Sussex (derived as no birth record found, but Archive item 5 shows date of grant of land called Bussex to son on 21 Aug 1573- assumed when is is 21). Henry married Dorothy and had lands "Ludwells", "Busses" & "Butchers" in West Hoathly and "Parkgate" in Ditchling. Henry left a 'Will' dated 5th September 1608 and he died on 10th September 1608 in Ditchling. Henry & Dorothy had at least seven children (see Archives item 9-Inquisition no 3 & also Archives item 8).
      1. Henry Payne was maybe possibly baptised on 18th April 1591 East Grinstead, Sussex (no parents shown ). He married Joan Hall. Details of Henry Payne & Joan Hall are shown separately.
        However this Henry may not be the correct one as Henry was possibly born in about 1589 (possible date is 27th July 1589 as he was 19 years 1 month 14 days at his fathers death (see Archives item 9-Inquisition no 3).

  1. Edward Payne (family ref top) left a 'Will' that was dated 6th March 1559 which was proved on 12th June 1566 . The link is to a partial transcript of the 'Will'.   5. Richard Payne (family ref ) left a 'Will' that was dated 22nd September 1606 which was proved on 15th April 1606!! . He was of Hapset. The link is to a transcript of the 'Will'. In the 'Will' he mentions his daughter Anne ; his son Edward (executor); his granddaughter Elizabeth (dau of Edward); Others: Richard Balcombe & his daughter Joane Balcombe ; witnesses were Richard Ritson? and George Lindfielde.

In the 'Will' he mentions his Wife Elynor (executor); his sons Richard, Thomas, William, John, Robert, Henry (last four under 18 & last five children of Elynor) ; his daughters Agnes Gele, Anne (or Amie), Joan (Johane), Cecilia (last two under 18 & children of Elynor); his godson Alexander Payne.     (Note: Livery of seisin is an archaic legal conveyancing ceremony, formerly practiced in feudal England and in other countries following English common law, used to convey holdings in property. The term "livery" is related, if not synonymous with, the word "delivery" as used in modern contract law. The common law in those jurisdictions once provided that a valid conveyance of a feudal tenure in land required the physical transfer by the transferor to the transferee, in the presence of witnesses, of a piece of the ground itself, in the literal sense of a hand-to-hand passing of an amount of soil, a twig, key, or other symbol.

  7. Transcription of an indenture From Richard Payne of west Hoathly to Thomas Budgen of Nutfield for the land on which to build a mill.
    The Indenture is worded as follows:-
    This indenture made the eleventh day of October in the seventeenth year of the Reign of our Sovereign Lord Charles the Second by the grace of God of England Scotland France and Ireland King defender of the Faith Anno Domini 1665 Between Richard Paine of Westhoathley in the County of Sussex Lord of the Manor of Burstowe in the County of Surrey of the one part and Thomas Budgen of Nutfield in the County of Surrey Miller of the other part WITNESSETH that the said Richard Paine for divers good causes and considerations him thereunto . . . enabling. . . Hath demised granted and farme letten and by these presents doth demise grant and to farme lett unto the said Thomas Budgen that peece or parcell of land and a windmill thereupon newly erected and built by the said Thomas Budgen containing by estimation halfe an acre situate lying and being in the parish of Burstowe aforsaid neere the Lane there called Bletchingly lane and being part of the wastground belonging to the said Mannor of Burstowe to HAVE AND TO HOLD the said peece or parcell of land and Mill with the appurtenances unto the said Thomas Budgen his Executors Administrators andAssigns from the Feast of St Michaell the Archangell last past before the date hereof unto the full end and terme of Five hundred yeares from thence next ensueing and fully to be compleat and ended YIELDING AND PAYING therefore yearely and every yeare during the said terme unto the said Richard Paine his Executors and Assigns the yearely rent or sume of five shillings of lawful money of England at the two most usuall Feasts or termes in the yeare that is to say the Feasts of the Annunciation of the blessed Virgin Mary and of St Michaell the Archangell by equall portions.

      Heir, son Henry, aged 19 years 1 month 14 days. Lands." Ludwells," "Busses" and "Butchers" in W. Hothly, cottage in Ditchling. Made will 5 Sept. 6 James to wife Dorothy "Ludwells" for life, paying son Henry 3 a year at 21 other property and lands called" Parkgate" in Ditchling to be sold for
